Minnesota Senate committee passes GAY MARRIAGE BAN!
After hours of passionate and often poignant testimony, a Minnesota Senate committee on Friday for the first time approved a constitutional amendment banning gay marriage.
They passed the Republican-sponsored bill on an 8-4 party-line vote, putting it on the ballot for Minnesotans to vote it up or down on the 2012 general election.
"I can't imagine anything more wholesome than for this group group of brave politicians to buck Hollywood and the politically correct cult, to define marriage by the vote of the people, rather than" one national leader said.
Same-sex marriage is already banned in the state under a decades-old law upheld by the state Supreme Court, . . .but the bill's chief sponsor, Sen. Warren Limmer, R-Maple Grove, said defining marriage is such an important issue that it should be decided by a public referendum.
House and Senate Republican leaders said earlier Friday they expect both chambers to approve the amendment next month. If they do, the question will be on next year's ballot.
The Gov. Mark Dayton does not have the authority to veto a constitutional amendment.
For years, the democratic PRO-GAY majority bottled up anti-gay marriage amendments. Howeverwith the TEA PARTY Rout with Republicans taking control of both houses this year for the first time in decades, the proposal is highly likely to pass.
The GOP platform had long favored a constitutional ban on same-sex marriage, and some Republican strategists have said putting the issue on the ballot would energizeAdvertisementQuantcasttheir supporters to turn out for the 2012 election.
The proposed amendment would recognize marriage as "only a union between one man and one woman."
The committee voted after 3 1/2 hours of debate dominated by clergy on both sides of the issue. Six Protestant, Catholic, Jewish and Muslim priests, pastors, rabbis and imams testified for the measure, while four religious leaders opposed it.
Most proponents said their religions believe marriage is exclusively a union between a man and a woman.
"Marriage is the one universal, common thread throughout the world and throughout history," Pastor Tom Parrish of Hope Lutheran Church in Minneapolis told the committee.
Legalizing same-sex marriage would, he said, "continually confuse and alienate us from one another and force those who believe in God's word to be lawbreakers by refusing to recognize or conduct same-sex marriages."
Speaking in opposition to the amendment, Rabbi Adam Spilker of Mount Zion Temple in St. Paul said, "To put morality to an up-or-down vote is to risk the majority imposing their religious views on the minority."
Opponents said a ban on same-sex marriage would insert legal discrimination into the Constitution for the first time.
Ann Kaner-Roth, executive director of Project 515, a marriage-equality advocacy group, said there are "at least 515 instances (in law) in which Minnesota's same-sex couples and their families are treated differently than their family members, friends, co-workers and members of their faith community." That's because the state grants rights based on the legal definition of marriage, she said.
But this year's version of the amendment would not prevent same-sex couples from seeking equal rights outside of marriage. In 2004, Limmer offered a bill that would have barred same-sex civil unions, as well as marriage. He said the current version would allow lawmakers to legalize civil unions.
St. Paul attorney Jane Bowman argued the proposed amendment is "redundant and unnecessary" because two state laws and a Supreme Court decision prohibit same-sex marriages.
But Austin Nimocks, an attorney for the Alliance Defense Fund, a conservative Christian advocacy group, said there's no guarantee those laws would be upheld in the future. "The next Minnesota court challenged with this demand may not demonstrate the same level of judicial restraint," he said.
"The Constitution is the people's document, and they are entitled to change it," Nimocks added.
Security at the hearing was extensive, not only in the crowded hearing room, but in a nearby overflow area, where more than 150 people gathered to watch on four television sets.
Many in the overflow crowd, almost all of them gay-rights proponents, carried signs, some of which read "Explain to me how my marriage affects yours ...?'' and "When do we get to vote on YOUR marriage?'' and "Love + Commitment = Marriage,'' and "I'm a Catholic who supports my LGBT Friends.''
Occasionally, the overflow crowd laughed, hissed or even booed during testimony in favor of the bill. At one point, security officials admonished them to be quieter.
During and after testimony from opponents, there often was spirited applause.
A companion bill is scheduled for its first House hearing Monday in the Civil Law Committee.
